Dangerous products
When a product causes harm due to poor design, manufacturing flaws, or inadequate warnings, victims may pursue a product liability claim. At Keeler & Keeler, we represent individuals and families injured by unsafe products across New Mexico and tribal jurisdictions.
Under New Mexico Law
New Mexico recognizes three main types of product liability claims:
1. Design Defect
- The product was inherently unsafe due to its design—even if manufactured correctly
- Example: A power tool lacking a safety guard
2. Manufacturing Defect
- The product was improperly made, deviating from its intended design
- Example: A batch of contaminated medication or a cracked helmet
3. Failure to Warn / Marketing Defect
- The product lacked adequate instructions or warnings about risks
- Example: A chemical cleaner without proper hazard labeling
Legal principles:
- Claims may be based on strict liability, negligence, or breach of warranty
- Plaintiffs must prove the product was defective, the defect caused injury, and the product was used as intended
